1. Acceptance of Terms
By accessing this website or engaging ForensiCore for any digital forensics, cyber investigation, incident response, or related services, you agree to be bound by these Terms and Conditions. If you do not agree, do not use our services.
2. Services Overview
ForensiCore provides computer forensics, mobile device forensics, network forensics, eDiscovery, data recovery, malware analysis, and incident response services. All services are performed in accordance with industry-standard forensic practices and applicable laws. The scope of work will be defined in a separate engagement letter or statement of work.
3. Confidentiality & Data Handling
We treat all client data, case details, and investigation findings as strictly confidential. Non-disclosure agreements (NDAs) are executed prior to the start of any engagement. Data is handled in encrypted form and stored in secure, access-controlled environments. We retain case data only for the period agreed upon, after which it is securely destroyed unless a legal hold requires otherwise.
4. Chain of Custody & Evidence Integrity
All digital evidence is acquired using forensically sound, write-blocked methods. A documented chain of custody is maintained from collection through to final disposition. Any alteration or tampering will render the evidence inadmissible; therefore, you must follow our guidance to preserve the original state of devices and data.
5. Client Responsibilities
You agree to provide accurate information, necessary access to systems and data, and to refrain from any action that may compromise evidence. You must not attempt to investigate or remediate incidents yourself after engaging us, as this may destroy crucial forensic artifacts. You are responsible for ensuring that your use of our services complies with all applicable laws.
6. Intellectual Property
All methodologies, tools, templates, and reports developed by ForensiCore remain our intellectual property. The deliverables provided to you (e.g., forensic reports, analysis results) are licensed for your internal use and for the specific legal matter for which they were created. You may not resell or distribute them without written consent.
7. Limitation of Liability
ForensiCore shall not be liable for any indirect, incidental, or consequential damages arising from the use of our services. Our total liability for any claim shall not exceed the fees paid for the specific engagement giving rise to the claim. Nothing in these terms limits liability that cannot be excluded under applicable law.
8. Indemnification
You agree to indemnify and hold harmless ForensiCore, its employees, and agents from any claims, damages, or expenses arising from your misuse of our services or violation of these terms.
9. Third-Party Tools & Links
Our website may reference third-party tools or contain links to external sites. We do not endorse and are not responsible for the content or practices of those third parties.
10. Termination
Either party may terminate an engagement with written notice. In the event of termination, you agree to pay for all services rendered up to the termination date. We will securely return or destroy your data in accordance with our data retention policy.
11. Governing Law & Disputes
These terms shall be governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in Wilmington, Delaware, unless otherwise agreed.
12. Changes to Terms
We reserve the right to modify these terms at any time. Updated versions will be posted on this page with a revised effective date. Continued use of our services after changes constitutes acceptance of the new terms.
